There has been a lot of discussion lately about agricultural machinery overhaul and there is still not much clarity on the subject.
In this article we will try to take stock of the situation and discover the new deadlines imposed to be in compliance with agricultural machinery.
According to the decree 111 of the highway code and the decree of 20 May 2015, the revision is mandatory from 30 June 2016.
This decree, however, was postponed for just causes. It is in fact impossible to be able to overhaul a tractor if the decrees are missing.
The verifications that must be carried out when the audit is carried out and also how the audit centers are organized in these specific cases have not been reported.
All these unknowns, however, did not prevent the overhaul of agricultural machinery from becoming law and therefore mandatory deadlines were established in the regulation of agricultural machinery.
The tractors registered before 1974 should have been overhauled by 31 December 2017, registered agricultural machinery between the years 1974 and 1990 by 31 December 2018.
With the simplification amendment, however, these deadlines have been postponed, considering those issued in the aforementioned decree no longer valid.
The new and mandatory deadline would be June 30, 2019.
On the other hand, there is a different deadline for all registered tractors before 1974. These will not expire at the end of June, but will have until the end of the year to regularize their position.
But at this point the problems are not over. The implementing decree has not yet been made explicit to actually explain how and where an agricultural machine must be overhauled.
This key passage, having not yet been disclosed, has thus fueled even more doubts and perplexities on the issue in question.
Instead, what has already been set are the new deadlines, here below we report all the new dates divided by vehicle years:

To qualitatively increase the supply of Italian wheat, we have provided support to increase the signing of supply chain contracts, so as to ensure a more equitable remuneration for agricultural work and quality parameters of durum wheat in compliance with the production needs of the pasta industry. To protect companies from market crises, the Ministry promotes an insurance policy for the stabilization of company revenues. Finally, on the milk front, we have foreseen investments for 120 million, we have activated the fund to restructure the debts and strengthen the moratorium on bank loans obtained with Abi and from 19 April the obligation to indicate the origin of milk and cheeses.
Multi-speed Italian agriculture. Sectors with income difficulties, others with excellent market outlets (agri-food) that make Made in Italy great. What interventions are possible to give homogeneity to the various supply chains, and how to redistribute the value in favor of farms?
Team play is essential. There is no growth in the sector without planning and collaboration between the parties. We are working to create new tools to promote organization and above all aggregation within the supply chains. Italy must make a qualitative leap from this point of view, shortening the inequalities that exist between the different areas of the country.
Simplification. Despite the interventions completed, farms are struggling with excessive bureaucracy and with delays and obstacles that slow down their competitiveness. How can it be improved?
It is a construction site that is always open. Much has been achieved thanks to Campolibero but there is still a lot to do. For small Italian farmers, for example, we have eliminated the paperwork for the single application for European contributions. In the wine we cut. We think, for example, of the fact that from 1 January the electronic register of wine is operational and mandatory, which allows you to eliminate paper registers, including the formalities connected with endorsement.
But let's also think about the bureaucratic simplification in terms of food waste. With the Gadda law we have made it easier for companies to donate than waste. Let us continue along this path by freeing our businesses from the snares of bureaucracy.
Industry 4.0: news announced aimed mostly at mechanization but also innovation, research and transfer to companies are strategic for the future of the sector. What actions does it intend to take?
We want an increasingly sustainable and cutting-edge primary sector and for this we are investing in research with a 21 million euro plan and in the application of new technologies. We have launched the Precision Agriculture Guidelines which are now an integral part of the Industry 4.0 project.
The goal is to reach 10% of the cultivated areas with these innovations by 2021. For the first time, budgeted farms and contractors will be able to access hyper-depreciation for investments in modern and sustainable technologies. For small and micro businesses we have created an Inail tender for 45 million euros for the purchase of more efficient and safer agricultural machinery.
Work theme. The law on illegal hiring contains positive and shareable aspects, but also the equation of administrative failures with crimes such as exploitation and actual hiring. Can a distinction be made?
The law against illegal hiring protects honest companies from unfair competition from those who exploit. However, we have set up a technical table with the other ministries involved for application guidelines that confirm this approach. The fight is against the corporals, not against those who eventually run into slight deficiencies.
For vouchers, agriculture continues to be criminalized, while other sectors have abused this tool. What do you think and what can be done also with the Minister of Labor?
In agriculture there has already been a squeeze, so much so that the vouchers here represent about 2% of the total of those used. In addition, it must be said that they can only be used for students, pensioners and those on layoffs. This could be a good method to apply to other sectors as well, but only after a thorough analysis. We must avoid accentuating insecurity.

Stage V (TIER 5), the regulations on emissions from agricultural and non-road mobile machinery (NRMM), entered into force on 1 January. To maintain the conformity of your machinery it is necessary to follow the rules imposed by the Regulations. Here are some useful clarifications for OEMs.
Stage V (TIER 5) entered into force on 1 January 2019, which implements the impositions of the 2016/1628 European Regulation (*). This legislation on emissions therefore becomes an obligation for tractors and non-road mobile machinery (NRMM or Non-road Mobile Machinery) placed on the market. There is still the possibility of using the transition regime for the placing on the market of tractors and non-road mobile machinery with transition engines, but from this year only engines that comply with the emission level set by Stage V. We take stock of the situation, examining and trying to clarify some of the issues that manufacturers are facing.
What reference power determines the emission category of an engine?
The reference power for variable speed motors is the maximum power, defined as the highest value of the net motor power on the rated full load power curve for the motor type, i.e. the maximum power according to the ECE R120 regulation which it is equivalent to ISO 14396. If there is more than one power curve, the highest curve should be used, regardless of the commercial power description used by the OEM. For most categories of constant speed motors, the reference power is the nominal power declared by the manufacturer. In this case the maximum power cannot exceed the rated power by more than 12.5%.
Is it still possible to continue manufacturing pre-phase V engines in the EU?
Another question that manufacturers are asking themselves concerns the possibility of continuing to produce engines of stages prior to phase V for the EU market.
For the purpose of manufacturing new machines, this is not allowed. There is, however, a transition scheme for tractors and non-road mobile machinery that have transition engines.
The obligations for manufacturers imposed by the legislation
Let's take a look at the obligations imposed on machine builders. First, OEMs cannot place machines on the market that are not equipped with engines that meet Stage V requirements, unless they are part of the permitted exceptions.
They are also required to follow all the instructions of the engine manufacturer to ensure that the one installed complies with the one approved for installation in the machine.
They must then assess whether the legal mark of the engine is visible once installed on the machine and, if it is not, they must ask the engine manufacturer to deliver the additional legal mark and place it on the machine or on the engine in a clearly visible position.
Finally, they must include, in the same format and in the same language as the operating and maintenance manual, a series of information for the end user, including:
- any restrictions or limitations on the use of the engine
- the maintenance requirements to keep the engine, including the aftertreatment system, running properly. For example, the quantities of urea solution to be used, the cleaning interventions to be carried out and the actions necessary to correct malfunctions deriving from these factors should be reported
- information on the possible loss of functionality of the machine, in the event that the above malfunctions are not corrected
- information on how intentional tampering with the engine, its control system and its exhaust gas post-treatment system invalidates the approval of the engine (and makes the end user responsible for any shortcomings)
- information on the correct, approved fuel for the engine
- information on the quality of the lubricating oil and replacement intervals
- the CO2 emission level, together with information on the test cycle on which this emission was measured.
